What should I confirm about pending transactions?
By Chris Sanford · Reviewed October 27, 2026
Pending transactions and active listings generally belong to the brokerage you are with when they're written. Before moving, get clear answers in writing from your current broker and your prospective one.
Confirm with your current brokerage
- Which transactions and listings stay with them, and how will compensation be handled?
- What does my independent contractor agreement say about departure?
- Who is responsible for closing files I'm leaving behind?
Confirm with the prospective brokerage
- When can I start, and what can I do before my pending deals close?
- How do they handle referrals back to my former brokerage?
Timing
Many agents plan a move around their pending pipeline. List every open file, its expected close date, and who owns it before choosing a date.
